1. Who we are

For the purposes of these Terms, “Verisa”, “we”, “us” and “our” refers to Joshua Winter, trading as Verisa.

Verisa may later operate through a formal legal entity. If that occurs, these Terms will be updated.

2. About Verisa

Verisa is an independent wellness travel platform designed to help travellers discover accommodation that supports wellbeing, movement, rest and recovery.

Verisa does not currently take bookings directly. Where booking links are provided, they direct you to the property, accommodation provider or third-party booking platform.

Unless expressly stated otherwise, Verisa is not the accommodation provider, travel agent, booking agent, tour operator or merchant of record for any stay, service or experience listed on the website.

3. No user accounts

At this stage, Verisa does not offer public user accounts or traveller registration.

You may be able to subscribe to updates, submit a property application, make an enquiry or interact with forms on the website. Those submissions are governed by these Terms and our Privacy Policy.

4. Property listings and verification

Property listings on Verisa are prepared in good faith using information available to Verisa, which may include property websites, publicly available information, direct communication with properties, submitted information, images, and Verisa’s own review or verification process.

We aim to provide accurate, useful and carefully considered information. However, accommodation facilities, amenities, pricing, availability, access, operating conditions and guest experiences may change after a listing has been reviewed or published.

Verisa’s verification process is intended to help travellers assess whether a property offers particular wellness-related features or experiences. It is not a guarantee that every listed amenity will be available, suitable, operating, staffed, maintained or accessible at all times.

Before booking, you should check directly with the property or booking provider to confirm any feature that is important to your stay, including wellness facilities, accessibility, inclusions, cancellation terms, family suitability, pet policies, transfers, parking, pricing and availability.

5. Bookings and third-party links

When you book a stay through a link on Verisa, your booking is made with the relevant property, accommodation provider or third-party booking platform.

Verisa is not a party to that booking or transaction.

The terms, conditions, prices, cancellation policies, refund policies and guest obligations of the relevant property or booking provider will apply to your booking.

We are not responsible for:

• booking availability;
• pricing changes;
• payment processing;
• cancellations or refunds;
• changes to accommodation or amenities;
• disputes between you and a property or booking provider;
• the quality, safety, suitability or performance of any accommodation, service or experience provided by a third party.

Some links on Verisa may be affiliate or referral links. This means Verisa may receive a commission or referral benefit if you click a link or make a booking through that link. This does not change the price you pay unless expressly stated.

6. Property applications

Accommodation providers, property owners or representatives may submit properties for consideration by Verisa.

Submitting a property application does not guarantee that the property will be listed, reviewed, approved, verified or published.

Verisa may accept, reject, edit, hold, remove or decline to publish any property listing at its discretion.

By submitting property information, images or other material, you confirm that:

• the information you provide is accurate and not misleading;
• you have authority to submit the property for consideration;
• you have the necessary rights or permissions to provide any images, text, logos, links or other material;
• Verisa may use the submitted material to assess, edit, prepare and publish a property listing, unless otherwise agreed in writing.

7. Acceptable use

You agree to use Verisa only for lawful purposes and in a way that does not interfere with the website, our systems, other users or the rights of others.

You must not:

• use the website for unlawful, misleading, fraudulent or harmful purposes;
• submit false, misleading or deceptive information;
• copy, scrape, harvest or extract content or data from the website without permission;
• interfere with the security, operation or availability of the website;
• attempt to gain unauthorised access to any system, database, account or admin area;
• upload or transmit malicious code, spam or harmful material;
• infringe any intellectual property, privacy or other rights;
• use Verisa content to build a competing database, directory, search platform or listing service without our written permission.

8. Intellectual property

Unless otherwise stated, the Verisa website, brand elements, editorial copy, design, layout, structure, verification framework, icons, graphics and other content are owned by or licensed to Verisa.

You may view and use the website for personal, non-commercial purposes.

You must not copy, reproduce, adapt, republish, distribute, sell, scrape, commercially exploit or use Verisa content without our prior written permission, except where permitted by law.

Property images, logos and brand materials may be owned by the relevant property, photographer, accommodation provider or rights holder. Their use on Verisa does not transfer ownership of those materials to you.

9. Editorial content

Verisa may publish editorial commentary, property descriptions, curated recommendations, amenity notes and wellness-related content.

This content is provided for general information and discovery purposes only. It is not professional travel, medical, health, legal, financial or safety advice.

You are responsible for making your own decisions before booking or travelling.

10. Accuracy and availability

We aim to keep Verisa accurate and available, but we do not guarantee that:

• the website will always be available, secure or error-free;
• all content will be complete, current or accurate;
• listed amenities will be available at the time of your stay;
• property descriptions will reflect every possible condition, limitation or change;
• third-party links will remain active or correct.

We may update, edit, remove or change website content at any time.

11. Disclaimers

To the maximum extent permitted by law, Verisa is provided on an “as is” and “as available” basis.

We exclude all warranties, representations or guarantees that may otherwise be implied, except where they cannot lawfully be excluded.

Nothing in these Terms is intended to exclude, restrict or modify any consumer rights or guarantees that cannot be excluded under applicable law, including rights under New Zealand or Australian consumer protection laws where those laws apply. New Zealand’s Fair Trading Act prohibits misleading conduct and false or unsubstantiated representations in trade, and New Zealand’s Consumer Guarantees Act provides minimum guarantees for certain goods and services supplied to consumers.

12. Limitation of liability

To the maximum extent permitted by law, Verisa is not liable for any loss, damage, cost, expense, claim or liability arising from or connected with:

• your use of or reliance on the website;
• errors, omissions or changes in website content;
• property listings, descriptions, images or amenities;
• third-party websites, booking platforms or accommodation providers;
• booking decisions made by you;
• unavailable or changed facilities;
• travel disruption, cancellation, injury, illness, loss, delay or inconvenience;
• unauthorised access, technical issues or website downtime.

Where Verisa’s liability cannot be excluded, our liability is limited to the maximum extent permitted by law.

13. Indemnity

You agree to indemnify Verisa against any claim, loss, liability, damage, cost or expense arising from:

• your misuse of the website;
• your breach of these Terms;
• information or material you submit to Verisa;
• your infringement of any third-party rights;
• any claim that property information, images or other material you submitted was inaccurate, misleading, unauthorised or unlawful.

14. Privacy

Your use of Verisa is also governed by our Privacy Policy.

The Privacy Policy explains how we collect, use, store and protect personal information.

15. Changes to these Terms

We may update these Terms from time to time as Verisa grows or as our services change.

The updated Terms will be published on this page with a new “Last updated” date.

If the changes are material, we may take additional steps to notify users, such as posting a notice on the website or sending an email to subscribers where appropriate.

Your continued use of Verisa after the updated Terms are published means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of New Zealand, unless otherwise required by applicable law.

You agree that any dispute relating to these Terms or your use of Verisa will be dealt with by the courts of New Zealand, subject to any mandatory rights you may have under consumer protection laws.
